2013 Maryland HB 171 Changes Organ Donation to “Opt Out” – withdrawn!

HB 171 changes the law from consent to “deemed consent”.

“THE ADMINISTRATION SHALL NOTIFY AN APPLICANT APPLYING FOR OR RENEWING A DRIVER’S LICENSE OR IDENTIFICATION CARD THAT THE APPLICANT SHALL BE DEEMED TO HAVE CONSENTED TO THE GIFT OF ALL BODY ORGANS OR PARTS FOR THE PURPOSES SPECIFIED IN PARAGRAPH (2) OF THIS SUBSECTION UNLESS THE APPLICANT EXPRESSLY CHOOSES NOT TO CONSENT.”

The current law is that each driver must “opt in”, upon license issue or renewal, to have his/her organs donated.  This change would presuppose that the State of Maryland has the right to your organs upon death, unless you expressly advise the State that you do not consent.
